Probst Partner at the Startup Nights

Around 8,000 visitors attended the Startup Nights in Winterthur. As in previous years, Probst Partner was present at this sixth edition with its own booth to keep its finger on the pulse of the startup community and to offer legal advice. In between the many interesting conversations, fun was not neglected: every visitor could test his luck and pick up one of the numerous prizes.

Lawsuit concerning copyright law in Germany: Eric Clapton sues a woman in Germany for selling a CD on ebay that was not authorised by Eric Clapton

Current press reports cover a copyright lawsuit in Germany. The world-famous musician Eric Clapton is said to have sued a woman because she wanted to sell on ebay a CD of one of his concerts, which the musician apparently did not authorise. The lawsuit is not directed against the producer of the said CD, but the private person who wanted to resell the CD online is sued.

Record fine against Whatsapp for Breaches of European Data Protection Regulations

The Irish Data Protection Commission DPC has imposed a fine of 225 million Euros on Whatsapp for violations of the provisions of the European General Data Protection Regulation (GDPR).

The investigation against Whatsapp, which has its European headquarters in Ireland, was initiated by the DPC in 2018 when the GDPR came into force. The background to the investigation were complaints from both Whatsapp users and third parties as well as a request for assistance from Der Bundesbeauftragte für Datenschutz und Informationsfreiheit (the German Federal Data Protection Authority) to the DPC, which were in connection with requests for information to Whatsapp. This also involved the transfer of personal data to other Facebook companies.

Corporate law reform: Changes concerning the Board of Directors

The Federal Law on Amendments to the Swiss Code of Obligations, which the Federal Councils passed on June 19, 2020, will comprehensively revise stock corporation law. The referendum deadline expired without having been used on October 8, 2020. The new law is expected to come into force in the second half of 2021.

The revision aims, among other things, to improve corporate governance at the board level. What is new?
